Consultation background
Fisheries New Zealand was consulting on whether to move the existing import and export prohibitions for toothfish and southern bluefin tuna into regulations under the Fisheries Act 1996. They were currently in orders under the Customs and Excise Act 2018.
The prohibitions require imports and exports of toothfish, and imports of southern bluefin tuna, to be accompanied by specified documents and meet certain conditions. These rules help New Zealand meet its international fisheries obligations.
Moving the prohibitions to the regulations would:
- reduce administration costs (orders must be reviewed every 3 years)
- reflect the long-term nature of the reasons for the prohibitions
- not change the requirements for importers or exporters of toothfish or southern bluefin tuna.
The consultation ran from 26 November to 21 December 2018.

Submissions are public information
Note, that any submission you make becomes public information. People can ask for copies of submissions under the Official Information Act 1982 (OIA). The OIA says we have to make submissions available unless we have a good reason for withholding it. That is explained in sections 6 and 9 of the OIA.
